REGISTRATION TERMS (MELBOURNE SISTAHOOD)
Please read the following terms and conditions carefully to ensure that you are fully aware of your rights and obligations when registering for the Melbourne Sistahood Program (the Program) via our website located at https://thequeenofconfidence.com/melbournesistahood/ (our Website).
Your decision to register to be a part of the Melbourne Sistahood means you acknowledge that you have read, understood and agree to be bound by the terms contained in this agreement (Terms). These Terms govern your use of the services offered in connection with the Program offered by Growth Consultancy Pty Ltd trading as The Queen of Confidence A.B.N.87 608 899 118 (we, us, our, or The Queen of Confidence) and you, a participant.
The Queen of Confidence may, from time to time, vary these terms and conditions and will provide notification via our Website. All amendments will be effective immediately upon a notification being displayed on our Website.
Accessing the Program
The Queen of Confidence provides Members with access to our Website and Program. You must be a current and valid member to access the Program.
Once you become a Member, your membership is ongoing, until such time that your Membership and/or agreement with us is terminated, in accordance with these terms.
If The Queen of Confidence provides you with access to any other of our programs or events, then you agree and acknowledge that you will be bound by separate terms and conditions relating to the other programs and/or events that you have been provided access to. You agree and acknowledge that The Queen of Confidence may terminate your access to additional programs and/or events, if you are no longer in good standing or you are not up to date with any payment plan that you may have in place with us.
You agree and acknowledge that:
- the Program runs for a whole 12 months and that, once registered, you are committed to the Program for a full 12 months; and
- you are not permitted to simply change your mind or withdraw from the Program and request a refund, as personal development takes time and full benefits are only experienced if you see the Program through to its conclusion.
Membership entitles you to a non-exclusive, non-transferable right to access and use the Program, subject to these Terms. Membership occurs when you register to become a Member, at which time, you warrant and represent that:
- you meet all applicable legal requirements, including age requirements, for doing so;
- you have authority to agree to these Terms;
- the information you provide when registering to become a Member is accurate, and that you will keep your contact information up to date;
- you will not use any user name or display name that is likely to mislead or deceive other users;
- you will not use any user name or display name that incorporates the name, image or likeness of another person;
- you are not registering to become a Member for anyone other than yourself, or the organisation that you represent;
- you will not transfer your Membership to any third party, without our prior written permission;
- you will keep your Membership secure and that you will not share your password or Membership, or do anything else so as to jeopardise the security of your Membership; and
- you will notify us immediately if you believe that any files or information you have accessed via the Program and/or the Website, contains viruses, spyware or other forms of malware.
You further agree and acknowledge that you are solely responsible for keeping all relevant and personal information, including but not limited to your Membership user name, passwords and other security features, confidential and secure to prevent unauthorised use of your Membership. If you reasonably suspect that the security of your Membership is compromised, you must notify us immediately. You agree to be solely responsible for any conduct associated with, or originating from, your Membership.
To the full extent permitted by law, we exclude liability or responsibility for any damages, liabilities, costs and expenses (including any direct, indirect, incidental, special or consequential damages and reasonable legal fees and expenses) arising out of, or related to, any breaches of the security of your Membership account, resulting from your act or omission to act.
All prices displayed on our Website are in Australian Dollars (AUD) and include Goods and Services Tax (GST). International orders do not contain GST.
We reserve the right to vary the prices displayed in connection with our Program from time to time and without notice to you.
You may pay for our Program via any payment method stated as being accepted on our Website. Please email us if you need to organise an alternate arrangement.
Once we have received your full payment for our Program in cleared funds, we will confirm your registration and provide you with relevant updates relating to the Program.
Cancellation of Membership
Cancellation by you
All registrations for our Program are final and cannot be cancelled by you.
Cancellation by The Queen of Confidence
We may cancel your registration for our Program, if for any reason, we are unable to hold the Program that you have registered for. We will provide you with a refund of the purchase price for the Program that you have registered for and that we are unable to provide.
We may also cancel your registration for our Program, if you are not respectful and inclusive of all other members or if you make any hateful or discriminatory comments regarding race, ethnicity, religion, disability, sexual orientation or political beliefs. You accept that if you engage in any such conduct, then you will be removed from the Program, without a refund.
You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from our cancellation of our Program.
All fees paid in association with your registration in our Program are non-refundable, unless we are required to make a refund under the Australian Consumer Law. Please email us if you feel that you are entitled to receive a refund from us.
Missed live event
If you miss an in-person event, we will email you any workbook or other resource that relates to that event. However, we will not post any material to you.
In this section of these Terms, “Event of Force Majeure” means an event beyond the control of The Queen of Confidence, which prevents a Party from complying with any of its obligations under these Terms, including but not limited to, further consequences from the Covid-19 pandemic, an act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods), war, military action, hostilities, rebellion, riots, strikes, virus, pandemic, epidemic, famine or plague, acts of threat or terrorism or action of a court.
In an Event of Force Majeure, the Queen of Confidence:
- will not be considered to be in breach of these Terms, to the extent that performance of its respective obligations (excluding payment obligations) is prevented by an Event of Force Majeure, which arises after the date that these Terms are entered into;
- will provide you with written notice outlining the inability to meet any obligations.
In light of the uncertainty of Covid-19 and restrictions on social gatherings, if The Queen of Confidence is unable to host an in-person event, then:
- if you registered for an in-person event during 2018 or 2019, then you will receive six in-person events, albeit at a time that in-person events can be conducted; and
- if you registered for an in-person event during 2020, then events will either be rescheduled for a later date or held online. You agree and acknowledge that you will not be entitled to receive a refund, in such circumstances.
All material contained in, or connected with, our Program are owned or under licence by The Queen of Confidence and protected by Australian and international laws.
Your participation in our Program does not grant you a licence or act as a right of use of any of the course material, or trade marks or logos, whether registered or unregistered, contained in, or connected with, our Program without the express written permission of The Queen of Confidence.
The Queen of Confidence owns the copyright, which subsists in all creative and literary works that are contained in, or connected with, our Program subject to certain works being under licence. You must not:
- reproduce or use any of the material contained in, or connected with, our Program; or
- in any way modify the material contained in, or connected with, our Program.
In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute any material or trade mark connected with our Program in any way except as expressly provided for by contained in, or connected with, our Program.
Enforcement of our intellectual property rights
The Queen of Confidence will not, under any circumstances, tolerate infringement of its intellectual property, whether such infringement is inadvertent or otherwise. In the event that you do any of the prohibited acts as listed above or infringe upon its intellectual property in any other way, The Queen of Confidence will enforce its intellectual property rights against you.
Not medical advice
You agree and acknowledge that no part of any program or event delivered by The Queen of Confidence constitutes medical advice, or any other type of advice. If you are experiencing any mental health illness, then The Queen of Confidence recommends that you seek the services of a suitable qualified mental heath professional.
Term of agreement
These Terms commence on the Membership Date and will continue, until such time that they are terminated under these Terms.
Acceptance will be deemed to have occurred when The Queen of Confidence communicates its acceptance to you in writing, including via email.
Termination will occur automatically at the end of the (12-month period.
The Queen of Confidence may terminate these Terms if you have committed any material breach of these Terms and in the case of a breach capable of being remedied, you have failed to remedy the breach within seven (7) days after the receipt of a written request from The Queen of Confidence.
The Queen of Confidence will, upon termination of your Membership and/or these Terms disable your user name and password and consequently, deny you access to the Services.
The information presented in our Program is to only serve as general information only. It is not intended to be comprehensive, nor does it constitute advice in any way. We attempt to ensure that the content is current and accurate, but we do not guarantee its currency and accuracy. You should carry out your own research and/or seek your own advice before acting or relying on any of the information presented in our Program. To the fullest extent permitted by the law, in material contained in, or associated with, our Program disclaims all liability (whether arising by negligence or otherwise) to any person, in respect of action taken in reliance on the information.
You acknowledge, accept and agree that by enrolling in our Program, you are fully responsible for your progress and the results derived from your participation in our Program. As you would be aware, the results achieved vary from person to person depending on personal attributes and/or objectives. Therefore, we offer no representations, warranties or guarantees, verbally or in writing, regarding your performance or any certain results that you may or may not achieve as a consequence of your registration or participation in our Program.
To the extent permitted by law, including but not limited to any act or omission on your part, we will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from any use or access of, or any inability to use or access, information relating to our Program.
Photo / Video Release
By accepting these Terms, you agree for us to take photos and videos during the course of our Program, in which you may feature.
You agree and acknowledge that we have an unrestricted and irrevocable right to use and republish any photos and/or videos that you may feature in. Such use may include commercial purposes and our promotion of future events held, in connection with our Program.
You agree to release and discharge us from any and all claims and demands arising out of, or in connection with, our use of the photographs and video footage.
By agreeing to these terms and conditions, you also consent to receive further electronic communications from us in relation to The Queen of Confidence business, including information relating to course offerings, competitions, promotions, special offers and any other commercial message. Of course, you may email us at any time to unsubscribe from receiving electronic commercial messages from us.
The laws of Victoria govern these Terms.
